NIE numbers
This number is needed if you are deciding to move to Spain.
You would need this if you are renting, buying a property, buying a car, working, setting up a business or registering with the social security department for medical cover.

WILLS
Having a Spanish will is very important if you have any properties or assets in Spain.
The will has to be signed in the Notary and registered for it to be legal. The will is drawn up in both Spanish and English, and is witnessed by the Notary and your legal representative.
The original is kept in the Notary, and you would be given a copia simple.
If you do not have a Spanish will, to be able to claim any inheritance, would be a long drawn out process, your English will would have to be legally translated and registered with the apostil stamp, this can take time, and can be expensive.

DEEDS / ESCRITURA
The deeds to your property have to be signed in the Notary, where all parties concerned have to present. This being sellers, buyers, banks (if mortgages are involved).
You would also need a legal representative, to translate and to carry out the administration work afterwards.
When buying a property, if a re-sale, you would have to pay 7% tax on the declared value of the property, Notary fees and land registration fees. These vary, normally a provision of funds is asked for, and once the property has been registered in your name any monies left outstanding are re-imbursed.
If it is a new build, you would pay your 7% tax on each instalment. Once you have signed your deeds you would have a 1% stamp duty to pay as well as the Notary and land registration fee.
When selling a property, the costs involved are: - the cancellation fees of mortgage (if applicable) in the Notary and land registrar. You are also liable for plus-valia, town hall capital gains tax (if you have been the owner of a property with deeds for more than one year). Also the council tax (rates) has to be paid for the year in which you sell the property. If you are a non-resident, 3% is retained from the declared value on deeds.

NOTARY
All legal paperwork has to be signed in the Notary, without this, the documents can not be legally registered.
Paper work that is signed in Notarias are:-
Deeds, mortgages, personal loans, power of attorneys, wills, registration of limited companies.
You will always need a translator with you, and you have to present a valid passport, NIE number or resident card.
